BrushPile Fishing Academy Terms and Conditions

This document outlines the terms and conditions for participation in the “BrushPile Fishing Academy” event organized by NKT Productions (“Organizer”) and BrushPile Fishing (“BrushPile Fishing”). By registering for and participating in the event, attendees agree to abide by these terms and conditions.

1)The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular equipment and personal discipline may reduce this risk, the risk of injury does exist; and

2)I KNOWINGLY AND FREELY ASSUME ALL SUCH RISK, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for any participants; and

3)I willingly agree to comply with the stated and customary terms and conditions for participants on. If, however, I observe any unusual significant hazard during my presence of participation, I will remove myself from participating and bring such matter(s) to the attention of the nearest BPFA Staff immediately; and

4)I, for myself and on behalf of my heirs, assigns, personal representative, and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS BrushPile Fishing, New Knoxville Telephone Co., their officers, agents, general manager, and employees, other participants, sponsoring agents, sponsors, advertisers, and if applicable, the owners or leasers of the premises used to conduct the event (Releasers), concerning ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASERS OR OTHERWISE to the fullest extent permitted by law.

5)Attendees grant BrushPile Fishing the unconditional right to use their name, voice, photographic likeness, and biographical information and fishing clips and instructors in connection with BrushPile Fishing. audio and video production, promotions, and or articles and press releases, and shall not be entitled to receive any royalties or other compensation with such use. I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTION OF RISK, AGREEMENT AND THE ATTACHED RULES, FULLY UNDERSTAND THEIR TERMS AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING AND SIGNING IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
